These Terms of Service ("Terms") are between you and Berry App Labs ("we," "us") and govern your use of In Good Company, a hosted culture game and related pages (the "Service"). By hosting or joining a game, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
In Good Company is a light, hosted game in which coworkers share fun, low-stakes facts and guess who said what. A host sets up a game, invites people to answer a handful of questions ahead of time, runs a live show, and can share a recap afterward. It is meant for warmth and connection, not for measurement of, or decisions about, any individual.
The Service is intended for workplace and adult use. You must be at least 16 years old to use it. There is no account to create; a game is reached through a code and, for hosts, a private link. Keep your host link private, it controls your game. You are responsible for activity that happens through your game or your device.
When you host, you agree that:
You keep ownership of the answers and photos you provide ("Your Content"). You grant us a limited, non-exclusive license to store, display, and process Your Content solely to operate the Service for you and your team, including showing it during the game and in the recap. You represent that Your Content is yours to share, that it does not infringe anyone's rights, and that any photo is of yourself or your own pet, and does not include other people, or minors, without their consent.
You agree not to: post content that is unlawful, harassing, hateful, harmful, deceptive, or that reveals someone's private or sensitive information without consent; impersonate others; attempt to access data that is not yours; disrupt, overload, scrape, reverse engineer, or probe the Service; or use it in a way that breaks the law or these Terms.
The optional "culture read" and score are generated with the help of an AI service from aggregate numbers, and are provided for general informational purposes. They may be incomplete or inaccurate, they are not professional, legal, HR, or psychological advice, and they should not be relied on to make decisions about people. You are responsible for how you use them.
The Service, including its software, design, questions, brand, and the mark "Powered by AI. Driven by Humans.", is owned by us or our licensors and is protected by law. We grant you a limited, revocable, non-transferable right to use the Service as intended. You may not copy, resell, or create derivative works from the Service except as we permit.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error free, or secure.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred US dollars.
You agree to indemnify and hold us harmless from claims, damages, and expenses arising out of Your Content, your use of the Service, or your breach of these Terms, to the extent permitted by law.
You may stop using the Service at any time, and a host may delete a game at any time. We may suspend or end access if you breach these Terms or to protect the Service or others. Sections that by their nature should survive, including ownership, disclaimers, limitation of liability, and indemnity, will survive.
These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules, and the state and federal courts located in Utah will have exclusive jurisdiction, except where local consumer-protection law gives you other rights. (Governing law and venue should be confirmed for your business.)
We may update these Terms from time to time. When we do, we will change the date above, and continued use of the Service after a change means you accept the updated Terms.
